These Terms of Service govern your use of Onboard Pulse and its services. By accessing, using, or interacting with our platform, website, and all associated features, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of our services indicates your acceptance of any changes we make.

Scope of Services

We provide an internal HR onboarding chatbot platform designed specifically for enterprises and corporate teams in Edmonton and beyond. Our services enable employee self-service functionality, automating routine HR processes including employee onboarding, benefits inquiries, policy information, and general HR support. The platform integrates with your existing enterprise systems to streamline workforce management and improve employee experience. Our services are intended for use by authorized employees within your organization and are not intended for public or external use.

User Obligations and Responsibilities

As a user of our platform, you agree to use our services only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of our services. Prohibited behavior includes harassing or causing distress or inconvenience to any person, obscene or offensive behavior, disrupting normal workflow, or interfering with our servers or networks. You are responsible for maintaining the confidentiality of your login credentials and account information. You agree to notify us immediately of any unauthorized access to your account. We are not liable for any unauthorized use of your account that occurs due to your negligence or failure to secure your credentials.

Intellectual Property Rights

All content on our platform, including text, graphics, logos, images, software, and other materials, is the property of our company or our content suppliers and is protected by international copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to access and use our platform for its intended business purposes. You may not reproduce, distribute, modify, create derivative works, or publicly display any content from our platform without our prior written permission. Any unauthorized use of our intellectual property is a violation of our rights and may result in legal action. We retain all rights not expressly granted to you.

Limitations of Liability

Our services are provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness of our platform for any particular purpose. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use our services, even if we have been advised of the possibility of such damages. Our total liability is limited to the amount paid by you in the past twelve months. Some jurisdictions do not allow liability limitations, so this may not apply to you.

Termination of Service

We reserve the right to terminate or suspend your access to our services at any time, with or without cause, and with or without notice. Grounds for termination include violation of these terms, misuse of our platform, non-payment of fees, or any conduct we deem harmful to our services or other users. Upon termination, your right to use our services ceases immediately. You remain responsible for any outstanding obligations or fees. We will not be liable to you or any third party for termination of your access. Certain provisions of these terms will survive termination, including intellectual property rights, limitations of liability, and governing law.

Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Canada and the Province of Alberta, without regard to its conflict of law principles. You agree that any legal action or proceeding relating to your use of our services shall be brought exclusively in the courts located in Edmonton, Alberta. By using our services, you consent to the jurisdiction and venue of these courts and waive any objections to venue or inconvenient forum. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
